1.1 By accessing, browsing, or placing an order on the SWEETDELUX website, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions, along with our Privacy Policy, Refund Policy, and any other policies referenced herein.
1.2 If you do not agree with any part of these Terms & Conditions, you must discontinue use of the website immediately and refrain from placing any orders.
2. Products & Descriptions
2.1 All SWEETDELUX products are handmade, artisanal, and produced in small batches with care and attention to quality.
2.2 Product images and descriptions on our website are provided to be as accurate as possible. However, due to the handmade nature of our products, slight variations in colour, texture, size, or appearance may occur. Such variations are inherent to artisanal production and are not considered defects.
2.3 SWEETDELUX reserves the right to modify, discontinue, or limit the availability of any product at any time without prior notice.
3. Pricing & Payment
3.1 All prices displayed on the SWEETDELUX website are listed in Canadian Dollars (CAD) unless otherwise stated. Prices are inclusive of product cost but may not include applicable taxes and shipping fees, which will be calculated at checkout.
3.2 Prices are subject to change without prior notice. The price charged for a product will be the price in effect at the time the order is placed.
3.3 Payment must be completed in full at the time of order using one of the accepted payment methods offered at checkout, which may include credit card, debit card, or other available payment options.
3.4 SWEETDELUX uses secure third-party payment processors to handle all transactions. We do not store, collect, or have access to your full payment card details.
4. Orders & Availability
4.1 Placing an order through the SWEETDELUX website constitutes an offer to purchase. SWEETDELUX reserves the right to accept or decline any order at its sole discretion, including but not limited to cases of pricing errors, suspected fraud, or product unavailability.
4.2 Due to the small-batch nature of our products, availability is limited. We may cancel, limit, or modify orders at our discretion and will notify you promptly should this occur.
4.3 An order confirmation email is sent upon successful processing of your order. This confirmation acknowledges receipt of your order but does not constitute a binding contract. A binding agreement is formed only when your order has been shipped and a shipping confirmation has been issued.
5. Shipping & Delivery
5.1 SWEETDELUX ships within Canada and may offer international shipping to select destinations where available. Shipping options and associated fees will be displayed at checkout.
5.2 Estimated delivery times are provided at checkout for informational purposes and are not guaranteed. Actual delivery times may vary based on destination, carrier performance, and other factors.
5.3 SWEETDELUX is not responsible for delays caused by shipping carriers, customs processing, weather events, natural disasters, or any other circumstances beyond our reasonable control.
5.4 Risk of loss or damage to products transfers to the buyer upon delivery of the shipment to the carrier.
6. Returns, Refunds & Exchanges
6.1 Due to the perishable and handmade nature of our products, all sales are generally final. We are unable to accept returns or exchanges for change of mind, taste preference, or buyer’s remorse. 6.2 If you receive a damaged, defective, or incorrect item, please contact us within 48 hours of delivery. Your claim must include clear photographs of the product and packaging, your order number, and a description of the issue.
6.3 Qualifying claims may be resolved through a refund to the original payment method, a replacement product, or store credit, at the sole discretion of SWEETDELUX. We may request the return of the product before processing a resolution.
6.4 Original shipping costs are non-refundable unless the need for a refund was caused by an error on the part of SWEETDELUX, such as shipping an incorrect or defective product.
6.5 Orders may be cancelled within twelve (12) hours of placement, provided they have not yet entered production. Custom and special orders cannot be cancelled once production has begun. For full cancellation details, please refer to our Refund Policy.
6.6 This section provides a summary of SWEETDELUX’s refund and cancellation practices. The SWEETDELUX Refund Policy, available on our website, contains full terms and procedures governing refunds, replacements, store credits, cancellations, and shipping issues. 7. Allergen & Dietary Information
7.1 SWEETDELUX products may contain or may have come into contact with common allergens, including but not limited to: nuts, peanuts, dairy, eggs, wheat, gluten, and soy. Our production facility is not an allergen-free environment.
7.2 While we strive to provide accurate ingredient and allergen information on our website and product packaging, customers with known allergies, sensitivities, or dietary restrictions should exercise caution. We encourage you to contact us directly with any questions before placing an order.
7.3 SWEETDELUX is not liable for any allergic reactions, adverse health effects, or other consequences resulting from the consumption of our products. Customers assume all risk associated with allergen exposure.
8. Intellectual Property
8.1 All content on the SWEETDELUX website — including but not limited to logos, brand marks, images, photographs, text, product names, packaging designs, and design elements — is the exclusive property of SWEETDELUX and is protected by Canadian and international intellectual property laws.
8.2 You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use any content from the SWEETDELUX website without prior written consent from SWEETDELUX.
9. User Accounts
9.1 Where the SWEETDELUX website offers account creation, users are responsible for maintaining the confidentiality of their login credentials, including username and password.
9.2 You are responsible for all activity that occurs under your account. You agree to notify SWEETDELUX immediately of any unauthorized use of your account or any breach of security.
9.3 SWEETDELUX reserves the right to suspend, deactivate, or terminate any user account that is found to be in violation of these Terms & Conditions, without prior notice.
10. Limitation of Liability
10.1 SWEETDELUX provides its products and services on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
10.2 To the maximum extent permitted by applicable law, SWEETDELUX, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of our website, products, or services.
10.3 In no event shall the total liability of SWEETDELUX exceed the amount actually paid by the customer for the specific product(s) giving rise to the claim.
11. Indemnification
11.1 You agree to indemnify, defend, and hold harmless SWEETDELUX, its owners, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to your misuse of the website, violation of these Terms & Conditions, or infringement of any rights of a third party.

12.1 These Terms & Conditions shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
12.2 Any disputes arising out of or in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts located in the Province of British Columbia, Canada.

13.1 SWEETDELUX reserves the right to update, amend, or modify these Terms & Conditions at any time and at its sole discretion.

14. Severability
14.1 If any provision of these Terms & Conditions is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed. The remaining provisions shall continue in full force and effect.
